    2 Purpose, Categories of Personal Data, Legal Basis and Retention
    2.1 Categories of your Personal Data and purposes of Our processing
    2.1.1

    We only collect your Personal Data when you provide it to us. For example, we will collect your name, email address, postal address, phone number, fax number, demographics and other information you provide us on our Websites. Our Websites are not intended for children and we do not knowingly collect Personal Data from children.

    We collect this Personal Data for the following purposes:

    • provide you with products requested and communicate with you about them;
    • respond to your comments and questions and provide customer service; and
    • send you information including confirmations, technical notices, updates, security alerts, support and administrative messages.

    When you visit our Websites and if you have granted your prior consent, some Personal Data on you is automatically collected: your computer's operating system, Internet Protocol (IP) address, browser type and language, and the last web page you visited are logged automatically. Subject to your prior consent, We also collect information about your usage and activity on our Websites.

    We collect this Personal Data for the following purposes:

    • to operate and improve our Websites and products;
    • to communicate with you about new promotions and upcoming events, and other news about products and services offered by Qorvo and our selected partners; and

    We do not make any automated decisions solely on automatic processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

    2.2 Legal basis for Our processing of your Personal Data

    Our processing of your Personal Data is allowed by law. The legal basis of our processing of your Personal Data set out (i) under Section 2.1 above is based on Article 6(1) (f) of the General Data Protection Regulation 2016/679 (the "GDPR") and in case of a contract with you, (ii) under Section 2.1.1 above is based on Article 6(1) (b) GDPR, i.e. the performance of the contract with you.

    2.3 Do you have to provide your Personal Data to Us?

    The provision of your Personal Data is voluntary. However, to provide you with information, which may include technical notices or administrative messages, your contact information is required; otherwise we cannot provide you with this information.

    2.4 Retention periods

    The retention periods for Personal Data depend on the purpose of the collection and processing of the Personal Data and the tool such data is processed in. The criteria used to determine the applicable retention period are that We will retain Personal Data set as described in this notice for as long as (i) necessary for the purpose described, (ii) you have consented to, and/or (iii) required by applicable statutory retention laws.

    3 Transfer of Personal Data to Third Parties
    3.1 Transfer of your Personal Data to third parties

    We share your Personal Data with third parties as follows:

    • with your consent when you agree to our sharing your Personal Data with other third parties for their own marketing purposes subject to their separate privacy policies;
    • with third party vendors, consultants and other service providers who are working on our behalf, assisting with website and IT system maintenance and support, and need access to your information to carry out their work for us;
    • (i) to comply with laws or to respond to lawful requests and legal process, (ii) to protect the rights and property of Qorvo, our agents, customers and others, including to enforce our agreements, policies and terms of use or (iii) in an emergency to protect the interests of Qorvo, its customers or any person;
    • in connection with any financing or merger with, sale of company assets to or acquisition of all or a portion of our business by another company to such other company.
    3.2 Transfer of your Personal Data to third parties in countries outside the European Union?

    In the event that the party to which We transfer your Personal Data as outlined in Section 3.1 is located outside the European Union in a country for which there is no adequacy decision by the European Commission (mostly the US), the appropriate safeguards We use to secure your Personal Data in the context of such transfers is EU Model Clauses.     4 Your Rights (incl. Right to Object)

    Under applicable data protection laws, you have the right:

    • to access your Personal Data, i.e. you may obtain confirmation from Us as to whether or not We process Personal Data of you and, if so, obtain access to such Personal Data;
    • to rectification of your Personal Data, i.e. you may obtain modification of inaccurate Personal Data;
    • to erasure of your Personal Data, i.e. you may demand your Personal Data to be deleted in certain circumstances (e.g., where processing of such Personal Data is no longer necessary for the purposes for which we collected or otherwise processed them);
    • to restrict the processing of your Personal Data, i.e. you may, in certain circumstances, demand the restriction of your Personal Data (e.g., if you contest the accuracy of such Personal Data, processing will be restricted for a period enabling Us to verify their accuracy);
    • to tell Us that you do not wish to receive marketing information;
    • to demand, in some circumstances, certain of your Personal Data to be transferred to you or a third party; and
    • not to be subject to a decision based solely on automated processing, including profiling, which produces effects concerning you or similarly significantly affects you.

    Furthermore, you have the right to object to Us processing your Personal Data at any time (i) in case of direct marketing or (ii) on grounds relating to your particular situation, in case We process your Personal Data for the purposes of Our legitimate interests. As to such purposes, you will find more information under Sections 2.1 and 2.2 above.

    To the extent Our processing of your Personal Data is based on your consent, you also have the right to withdraw your consent, without affecting the lawfulness of Our processing based on your consent before its withdrawal.

    Exercising any of your rights mentioned above is subject to legal prerequisites and, in certain circumstances, your rights may be limited due to legal exceptions set out, in particular, in Arts. 17 para. 3 and 22 para. 2 GDPR.
